The Weights and Measures (Amendment) Regulations 1979

The Secretary of State, in exercise of the powers conferred by sections 11(1) and 54(1) of the Weights and Measures Act 1963 (hereinafter called “the Act”) and now vested in him[^f00001], and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

These Regulations may be cited as the Weights and Measures (Amendment) Regulations 1979 and shall come into operation on 1st January 1980.

The Weights and Measures Regulations 1963[^f00002] are hereby amended by adding to Regulation 1(2) the following—

(d) weighing equipment for use only for making up packages if, and only if, the packages are subsequently checked in accordance with section 1(6)(b) of the Weights and Measures Act 1979[^f00003]; (e) weighing equipment specified in paragraph 7 of Schedule 4 to the Weights and Measures (Packaged Goods) Regulations 1979[^f00004] for use only for checking packages in accordance with section 1(6)(b) or (7)(a) of the said Act; and (f) liquid capacity measures specified in paragraph 4 of the said Schedule 4 for use only for making up or checking packages in accordance with section 1(6) or (7)(a) of the said Act. In this paragraph ‘packages’ means packages as defined in section 14(1) of the Weights and Measures Act 1979.

Explanatory note

EXPLANATORY NOTE

These Regulations further amend the Weights and Measures Regulations 1963 by excluding from the application of those Regulations—

(a) weighing equipment used for making up packages so long as they are subsequently checked in accordance with section 1(6)(b) of the Weights and Measures Act 1979;

(b) certain weighing equipment used for checking packages in accordance with section 1(6)(b) or (7)(a) of that Act;

(c) certain liquid capacity measures used for making up or checking packages in accordance with section 1(6) or (7)(a) of that Act.

Such equipment will, therefore, not be prescribed for the purposes of section 11(1) of the Weights and Measures Act 1963.
