The Employment Agencies Act 1973 (Exemption) (No. 2) Regulations 1979

The Secretary of State in exercise of the powers conferred on him by sections 12(1) and 13(7)(i) of the Employment Agencies Act 1973 and of all other powers enabling him in that behalf, and after consultation as required by section 12(2) of the said Act with bodies appearing to him to be representative of the interests concerned, hereby makes the following Regulations:—
Citation and commencement

These Regulations may be cited as the Employment Agencies Act 1973 (Exemption) (No. 2) Regulations 1979 and shall come into operation on 4th February 1980.
Exemption

- (1) The Employment Agencies Act 1973 shall not apply—
- (a) to any services provided for its members by an organisation, or by a company established by any such organisation, being an organisation or company listed in Part I of the Schedule to these Regulations;
- (b) to any services provided for its members by the organisation listed in Part II of the said Schedule;
- (c) to any business carried on, or any services provided by, the Crown Agents for Oversea Governments and Administrations or by any of its wholly owned subsidiaries.
- (2)
- (a) For the purposes of paragraph (1)(a) and (b) above—
- “members” includes persons registered with the organisation as trainees or students,
and
- (b) for the purpose of paragraph (1)(c) above—
- “wholly owned subsidiary” shall be construed in accordance with section 150(4) of the Companies Act 1948.
SCHEDULE — EXEMPT ORGANISATIONS
The following organisations are exempt—
PART I
- The Royal Institute of British Architects and RIBA Services Limited
- The Law Society and Law Society Services Limited.
PART II
The Incorporated Brewers' Guild.

Explanatory note
EXPLANATORY NOTE
These Regulations exempt from the licensing and other provisions of the Employment Agencies Act 1973 certain named organisations (and companies established by those organisations) which provide services for their members and registered students and also the Crown Agents for Oversea Governments and Administrations, which as from 1st January 1980 become a body corporate.
