The Scholarships and Other Benefits (Amendment) (No. 2) Regulations 1979

Coming into Operation: 14th June 1979

In exercise of the powers conferred by section 81 of the Education Act 1944[^f00001] and vested in the Secretary of State[^f00002], the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:—

These Regulations may be cited as the Scholarships and Other Benefits (Amendment) (No. 2) Regulations 1979 and shall come into operation on 14th June 1979.

In Regulation 4 of the Scholarships and Other Benefits Regulations 1977[^f00003] (grants of scholarships and other benefits) for the words “Subject to Regulations 5 and 6” there shall be substituted the words “Subject to Regulation 6”.

Regulation 5 of the said Regulations of 1977 (restrictions on the making of payments under Regulation 4(d)) is hereby revoked.

Explanatory note

EXPLANATORY NOTE

These Regulations revoke Regulation 5 of the Scholarships and Other Benefits Regulations 1977. Accordingly, a local education authority will no longer be required to obtain the approval of the Secretary of State before paying fees etc. under Regulation 4(d) in respect of children attending non-maintained schools.
