The Non-Marketing of Milk and Milk Products and the Dairy Herd Conversion Premiums (Amendment) Regulations 1980

The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated[^f00001] for the purposes of section 2(2) of the European Communities Act 1972 in relation to the Common Agricultural Policy of the European Economic Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all their other enabling powers, hereby make the following regulations:—

Citation and commencement

These regulations, which amend the Non-Marketing of Milk and Milk Products and the Dairy Herd Conversion Premiums Regulations 1977 (hereinafter referred to as “the principal regulations”), may be cited as the Non-Marketing of Milk and Milk Products and the Dairy Herd Conversion Premiums (Amendment) Regulations 1980 and shall come into operation on 3rd March 1980.

Amendment to regulation 2 of the principal regulations

Paragraph (1) of regulation 2 of the principal regulations shall be amended as follows:—

• (a) in the definition of “the Regulation of the Council” immediately after the words “17th May 1977(c)” there shall be inserted the words “as amended by Regulation (EEC) No. 506/78 of the Council of 7th March 1978 Regulation (EEC) No. 1041/78 of the Council of 22nd May 1978 Regulation (EEC) No. 640/79 of the Council of 29th March 1979 and Regulation (EEC) No. 1270/79 of the Council of 25th June 1979;”,

• (b) for the definition of “the Regulation of the Commission” there shall be substituted the following definition:—

• ‘the Regulation of the Commission’ means Regulation (EEC) No. 1391/78 of the Commission of 23rd June 1978[^f00002] as amended by Regulation (EEC) No. 2962/78 of the Commission of 15th December 1978[^f00003] and Regulation (EEC) No. 1799/79 of the Commission of 13th August 1979[^f00004]

Explanatory note

EXPLANATORY NOTE

These Regulations amend the Non-Marketing of Milk and Milk Products and the Dairy Herd Conversion Premiums Regulations 1977. The 1977 Regulations supplement certain regulations therein defined as “the Regulation of the Council” and “the Regulation of the Commission”, which establish schemes for a system of premiums for the non-marketing of milk and milk products and for the conversion of dairy herds, by providing certain enforcement powers such as powers relating to entry on premises, inspection and the recovery of premiums. The regulations establishing the schemes have been extended, revised or superseded by subsequent regulations and the present amending Regulations take account of this by amending the definition “the Regulation of the Council” in the 1977 Regulations by including references to amending regulations and by amending the definition “the Regulation of the Commission” by substituting references to current regulations relating to the Schemes.
