The Secretary of State in exercise of the powers conferred on him by section 65(2) of the Ancient Monuments and Archaeological Areas Act 1979 and of all other powers enabling him in that behalf hereby makes the following order:—

This order may be cited as the Ancient Monuments and Archaeological Areas Act 1979 (Commencement No. 3) Order 1981.

The day appointed for the coming into force in Scotland of Parts I and III of and Schedules 1, 3, 4 and 5 to the Ancient Monuments and Archaeological Areas Act 1979 shall be 30th November 1981.

Explanatory note

EXPLANATORY NOTE

This Order provides for the coming into force in Scotland of Parts I and III of the Ancient Monuments and Archaeological Areas Act 1979. Part I provides for the scheduling and protection of monuments of national importance, their acquisition or guardianship by the Secretary of State or a local authority, public access to monuments under public control and continuance of the Ancient Monuments Board for Scotland. Part III relates to powers of entry to land, compensation for damage caused in the exercise of these powers, and the recovery of grants for expenditure in conservation areas and on historic buildings, and provides for restrictions on the use of metal detectors, the treatment and preservation of archaeological finds and grants to the Architectural Heritage Fund. Part III also repeals all previous legislation on ancient monuments.
