The British Dependent Territories Citizenship (Designated Service) Order 1982

Whereas I consider the descriptions of service specified in this Order to be closely associated with the activities outside the dependent territories of the government of a dependent territory:

Now, therefore, in exercise of the powers conferred upon me by section 16(3) of the British Nationality Act 1981, I hereby make the following Order:—

This Order may be cited as the British Dependent Territories Citizenship (Designated Service) Order 1982 and shall come into operation on 1st January 1983.

The descriptions of service specified in the Schedule to this Order are hereby designated for the purposes of section 16 of the British Nationality Act 1981 (which relates to acquisition of British Dependent Territories citizenship by persons born outside the dependent territories).

SCHEDULE — SERVICE DESIGNATED FOR PURPOSES OF SECTION 16 OF BRITISH NATIONALITY ACT 1981

Service in pursuance of an appointment outside the dependent territories in respect of which the person concerned is on secondment from Crown service under the government of a dependent territory. For this purpose, a person is on secondment from Crown service under the government of a dependent territory if, having been serving in such Crown service, he is for the time being in temporary service under arrangements whereby he is to return to such Crown service when that temporary service ends.

Service under the Hong Kong Tourist Association.

Service under the Hong Kong Trade Development Council.

Explanatory note

EXPLANATORY NOTE

Section 16 of the British Nationality Act 1981 (which comes into force on 1st January 1983—see S.I. 1982/933) provides, inter alia, that a person born outside the dependent territories after the commencement of the Act is a British Dependent Territories citizen if at the time of the birth his father or mother is such a citizen and is serving outside the dependent territories in service designated by the Secretary of State, recruitment for that service having taken place in a dependent territory. This Order designates various types of service for the purposes of this provision.
