The Pottery (Health etc.) (Metrication) Regulations 1982

The Secretary of State, in exercise of the powers conferred on him by sections 49(1), (2) and (4) and 82(3)(a) of the Health and Safety at Work etc. Act 1974[^f00001] (“the 1974 Act”) and of all other powers enabling him in that behalf and for the purpose of giving effect without modification to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following Regulations:—

Citation, commencement and interpretation

• (1) These Regulations may be cited as The Pottery (Health etc.) (Metrication) Regulations 1982 and shall come into operation on 1st October 1982.

• (2) In these Regulations, unless the context otherwise requires, “the principal Regulations” mean the Regulations which are amended by Regulation 2 of these Regulations, that is to say:—

• The Pottery (Health) Special Regulations 1947;

• The Pottery (Health and Welfare) Special Regulations 1950[^f00002].

Amendments to the principal Regulations to substitute metric measurements for imperial and other measurements

The provisions of the principal Regulations specified in the Schedule to these Regulations in column 1 shall be amended by substituting for the measurements set out opposite thereto in column 3 the measurements set out in the corresponding entry in column 4.

Amendments to the Abstract of Special Regulations (Pottery—Health and Welfare) Order 1973

In Schedules 1 and 2 of the Abstract of Special Regulations (Pottery—Health and Welfare) Order 1973, which reproduce parts of the Pottery (Health and Welfare) Special Regulations 1950, there shall be substituted for the measurements set out in the relevant entries in the Schedule to these Regulations in column 3 the measurements set out opposite thereto in column 4.

Application to existing premises and plant or premises and plant under construction

Where any premises or plant in existence or under construction immediately before the coming into operation of these Regulations complied with the requirements of the principal Regulations as then in force, those premises or that plant shall be deemed to comply with the principal Regulations as amended by these Regulations.

Explanatory note

EXPLANATORY NOTE

These Regulations amend—

• The Pottery (Health) Special Regulations 1947; and

• The Pottery (Health and Welfare) Special Regulations 1950;

by substituting amounts or quantities expressed in metric units for amounts or quantities not so expressed or expressed in metric units of a different description and, by Regulation 3, the Abstract of Special Regulations (Pottery—Health and Welfare) Order 1973 is similarly amended.

Regulation 4 provides that the amendments do not relate to premises or plant in existence or under construction immediately before the coming into operation of these Regulations if those premises or that plant complied with the then existing Regulations.
