The Importation of Animal Products and Poultry Products (Amendment) Order 1982

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 1, 10, 87(5)(a), 88(2) and 88(4)(a) of the Animal Health Act 1981 and of all other powers enabling them in that behalf, hereby order as follows:—
Title and commencement

This order may be cited as the Importation of Animal Products and Poultry Products (Amendment) Order 1982 and shall come into operation on 9th August 1982.
Amendment of principal Order

The Importation of Animal Products and Poultry Products Order 1980[^f00001] shall be amended as follows:—
- (a) for Article 2 there shall be substituted the following Article—
(2) For the purposes of the Animal Health Act 1981 (“the 1981 Act”) in its application to this order— (a) the definition of “poultry” in section 87(4) of the 1981 Act is hereby extended so as to comprise grouse, ostriches, quails, snipe and woodcock; and (b) the definition of “disease” in section 88(1) and (3) of the 1981 Act is hereby extended so as to comprise any disease of animals or birds.
- (b) in Article 3 (interpretation) for the definition of “animal” there shall be substituted the following definition—
- “animal” means any kind of mammal except man
and
- (c) in the Schedule (which mentions animal products and poultry products to which the prohibition on landing contained in Article 4(1) does not apply) the words “Steamed bone flour” shall be omitted.

Explanatory note
EXPLANATORY NOTE
The Importation of Animal Products and Poultry Products Order 1980 as amended (“the principal Order”) prohibits the landing in Great Britain of any animal product or poultry product from a place outside Great Britain except under the authority of a licence. The prohibition does not apply to the products mentioned in the Schedule to the principal Order.
This Order amends the principal Order by—
(1) extending the definition of poultry in section 87(4) of the Animal Health Act 1981 in its application to the principal Order so as to include grouse, ostriches, snipe and woodcock;
(2) substituting references to the Animal Health Act 1981 for those to the Diseases of Animals Act 1950 (c. 36) in the extension of the definition of disease in the principal Order;
(3) substituting a wider definition of animal for that previously contained in the principal Order, animal being defined as meaning any kind of mammal except man; and
(4) omitting steamed bone flour from the Schedule to the principal Order. Steamed bone flour will therefore become subject to the prohibition on landing contained in the principal Order, unless it is landed under the authority of a licence and in accordance with the conditions of that licence.
