Coming into Operation: 12th August 1983

The Secretary of State for Transport, in exercise of the powers conferred by section 103(1) of the Road Traffic Regulation Act 1967[^f00001] and section 193(1) of the Road Traffic Act 1972[^f00002], now vested in him[^f00003], and of all other enabling powers, and after consultation with representative organisations in accordance with section 107(2) of the said Act of 1967 and with section 199(2) of the said Act of 1972, hereby makes the following Regulations:—

In these Regulations—

The class of electrically assisted pedal cycles prescribed for the purposes of section 103 of the Road Traffic Regulation Act 1967 and section 193 of the Road Traffic Act 1972 consists of bicycles or tricycles which comply with the requirements specified in Regulation 4 below.

The requirements referred to in Regulation 3 above are that the vehicle shall:—

Explanatory note

EXPLANATORY NOTE

1.

These Regulations are made pursuant to section 24 of the Transport Act 1981 (which has been brought into force by the Transport Act 1981 (Commencement No. 9) Order 1983 (S.I. 1983/576 (c.16))). That section provided for the addition to section 103 of the Road Traffic Regulation Act 1967 (by virtue of which certain vehicles are not treated as motor vehicles for the purposes of that Act) and section 193 of the Road Traffic Act 1972 (by virtue of which certain vehicles are not treated as motor vehicles for the purposes of that Act) of an electrically assisted pedal cycle of such class as may be prescribed by regulations.

By Regulation 3 of these Regulations the class of electrically assisted pedal cycles prescribed for the purposes of section 103 of the 1967 Act and section 193 of the 1972 Act are vehicles which comply with the requirements specified in Regulation 4. Certain terms used in these Regulations are defined in Regulation 2.
