The National Health Service (Amendment of Trust Instruments) Order 1983

Coming into Operation: 1st April 1983

The Secretary of State for Social Services in exercise of the power conferred on him by section 92(5) of the National Health Service Act 1977 and all other powers enabling him in that behalf, in consequence of the apportionment of trust property under that section[^f00001], hereby makes the following Order:—

Citation and commencement

This Order may be cited as the National Health Service (Amendment of Trust Instruments) Order 1983 and shall come into operation on 1st April 1983.

Amendment of schemes

The schemes mentioned in the Schedule to this Order shall be amended so that in respect of each portion of the investments and moneys which formerly constituted combined pools set up under those schemes and which have been transferred to a District Health Authority as trust property under Article 6(1) of the National Health Service (Determination of Districts) Order 1981 and any accretion thereto, references to that District Health Authority shall be substituted for references to an Area Health Authority.

Amendment of other instruments

Any reference to an Area Health Authority in a document relating to an investment or sum of money which formed part of any combined pool constituted under a scheme mentioned in the Schedule to this Order shall be amended so as to be a reference to the District Health Authority to which that investment or sum of money has been apportioned under Article 6(1) of the National Health Service (Determination of Districts) Order 1981.

SCHEDULE — SCHEMES TO WHICH THIS ORDER APPLIES

The scheme for certain charities formerly administered by Nottinghamshire Area Health Authority (Teaching) sealed by the Charity Commission on the 13th March 1979 and numbered N79(S)/79.

The scheme for certain charities formerly administered by Kent Area Health Authority sealed by the Charity Commission on the 14th April 1980 and numbered 195(S)/80.

Explanatory note

EXPLANATORY NOTE

This Order amends schemes and other trust instruments in consequence of the transfer of hospital trust property from Area Health Authorities to District Health Authorities by Article 6(1) of the National Health Service (Determination of Districts) Order 1981. It applies to trust property formerly held by the Area Health Authorities mentioned in the Schedule in combined investment pools and permits District Health Authorities to hold such trust property apportioned to them in combined pools.
