The Mobile Homes (Commissions) Order 1983

The Secretary of State, in exercise of the powers conferred upon him by paragraph 8 of Part I of Schedule 1 to the Mobile Homes Act 1983 and of all other powers enabling him in that behalf, hereby makes the following order:—

This order may be cited as the Mobile Homes (Commissions) Order 1983 and shall come into operation on 20th May 1983.

The maximum rate of commission to which an owner shall be entitled, under the provisions of paragraph 8 of Part I of Schedule 1 to the Mobile Homes Act 1983, on the sale by an occupier of a mobile home shall be 10 per cent.

Explanatory note
EXPLANATORY NOTE
The Mobile Homes Act 1983 provides for certain terms to be implied into any agreement under which a mobile home occupier is entitled to station a mobile home on land forming part of a protected site. These terms are set out in Part I of Schedule 1 to the Act. Paragraph 8 of Part I deals with the sale of the mobile home by the occupier and the assignment of the agreement. Under paragraph 8(2) the owner of the site is entitled to receive a commission on such a sale at a rate not exceeding that specified by order. This order fixes the maximum rate of commission at 10 per cent.
