The Secretary of State, in exercise of the powers conferred on him by section 11(4) of the Clean Air Act 1956, and now vested in him[^f00001], and of all other powers enabling him in that behalf, being satisfied that fireplaces of the classes described in the Schedule hereto can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby makes the following order:—
Title, commencement and extent

- (1) This order may be cited as the Smoke Control Areas (Exempted Fireplaces) Order 1984 and shall come into operation on 24th November 1984.
- (2) This order shall extend to England and Wales.
Classes of fireplace exempted from section 11 of the Clean Air Act 1956

- (1) Fireplaces of the classes described in the Schedule hereto shall, upon the conditions specified in paragraph (2) below, be exempted from the provisions of section 11 of the Clean Air Act 1956 (which empowers a local authority to declare the whole or any part of their district to be a smoke control area).
- (2) The conditions mentioned in paragraph (1) are that the fireplace shall be installed, maintained and operated so as to minimise the emission of smoke at all times, and in accordance with the relevant manufacturer's instructions which bear the appropriate reference specified in the said Schedule.
Revocation

The Smoke Control Areas (Exempted Fireplaces) (No. 4) Order 1983 is hereby revoked.

Explanatory note
EXPLANATORY NOTE
Section 11 of the Clean Air Act 1956 empowers local authorities to declare the whole or any part of their district to be a smoke control area in which the emission of smoke is generally prohibited. Specified classes of fireplaces may be exempted from control by order.
This order, which applies to England and Wales, exempts the Parkray Coalmaster II fireplace manufactured by T.I. Parkray Limited and the Spacewarmer B200 and the Spacewarmer B500 fireplaces manufactured by Clean Air Systems subject to certain conditions as to installation, maintenance and operation.
The order replaces with modifications the Smoke Control Areas (Exempted Fireplaces) (No. 4) Order 1983, which is revoked. The changes are—
(1) Exemption is now given to Spacewarmer B200 and B500 fireplaces.
(2) New provision is made as respects the Parkray Coalmaster to take account of the existence of inset and free-standing models.
