The Secretary of State for Transport, in exercise of his powers under section 70(3) of the Transport Act 1982 and all other powers enabling him in that behalf, hereby makes the following Order:—

This Order may be cited as the Motor Vehicles (Payments in Respect of Applicants for Exemption from Wearing Seat Belts) Order 1984 and shall come into operation on 1st February 1985.

Section 70(2)(a) of the Transport Act 1982 (which specifies certain classes relating to payments in respect of applicants for exemption from wearing seat belts) shall be amended so as to add, after sub-sub-paragraph (iv) the following:

(v) a mobility supplement under a scheme made under the Personal Injuries (Emergency Provisions) Act 1939 [^f00001] or under an Order in Council made under section 12 of the Social Security (Miscellaneous Provisions) Act 1977 [^f00002] (war pensioners mobility supplement); or (vi) a disability pension paid by the Secretary of State for Defence on account of disability attributable to injury sustained after 30th September 1921 but before 3rd September 1939 together with a mobility supplement paid under the Naval and Marine Pay and Pensions (Disablement Awards) (No. 2) Order 1984 or under Royal Warrant dated 30th December 1949 or under Queen's Regulations for the Royal Air Force.

Explanatory note

EXPLANATORY NOTE

This Order amends section 70 of the Transport Act 1982 so as to enable the Secretary of State to make payments in respect of those applicants for exemption from wearing seat belts who are in receipt of war pensioners' mobility supplement.

The Naval and Marine Pay and Pensions (Disablement Awards) (No. 2) Order 1984 is an Order in Council made under Section 11 of the Naval and Marine Pay and Pensions Act 1865 (c. 73); it is not published. Queen's Regulations for the Royal Air Force 4th Edition 1971 is published by HMSO. The Royal Warrant dated 30 December 1949 (as amended) is not published.
