The Diseases of Fish (Definition of “Infected”) Order 1984

The Minister of Agriculture, Fisheries and Food in relation to England, and any marine waters adjacent to England, the Secretary of State for Scotland in relation to Scotland (including the marine waters thereof) and the Secretary of State for Wales in relation to Wales, and any marine waters adjacent to Wales, in exercise of the powers conferred on them by section 13(1) of the Diseases of Fish Act 1937[^f00001], and of all other powers enabling them in that behalf, hereby make the following order:—

Title and commencement

This order may be cited as the Diseases of Fish (Definition of “Infected”) Order 1984 and shall come into operation on 1st April 1984.

Amendment of definition of “infected” in Diseases of Fish Act 1937

For the definition of “infected” in section 10(1) of the Diseases of Fish Act 1937 there shall be substituted the following definition—

• ‘infected’ means, in relation to fish, infected with any of the diseases respectively known as bacterial kidney disease (BKD), furunculosis of salmon, infectious haematopoietic necrosis (IHN), infectious pancreatic necrosis (IPN), spring viraemia of carp (SVC), viral haemorrhagic septicaemia (VHS) and whirling disease (Myxosoma cerebralis);”.

Revocation

There are hereby revoked—

• (a) article 3 and article 4, except in so far as that article relates to the definition of the expression “infected waters”, of the Diseases of Fish Order 1973 and

• (b) the Diseases of Fish Order 1978.

Explanatory note

EXPLANATORY NOTE

This order amends the list of diseases to which the provisions of the Diseases of Fish Act 1937, as amended, apply by substituting a new definition of “infected” in section 10(1) of that Act. Furunculosis, columnaris, ulcerative dermal necrosis (UDN) and infectious dropsy of cyprinids (IDC or IAD) in any of its forms including spring viraemia and erythrodermatitis are removed from the list and furunculosis of salmon and spring viraemia of carp (SVC) are added to the list.

The order revokes the Diseases of Fish Order 1973 (subject to a saving for the definition of “infected waters”) and the Diseases of Fish Order 1978.
