Coming into Operation: 1st November 1985

The Secretary of State concerned with health in England, the Secretaries of State respectively concerned with health and with agriculture in Wales and in Scotland, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of powers conferred by sections 51 and 129(4) of the Medicines Act 1968 and now vested in them[^f00001] and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by this order pursuant to section 129(6) of that Act, and after consulting and taking into account the advice of the Medicines Commission pursuant to section 129(7) of that Act, hereby make the following order:—

In Article 1(2)(a) of the principal order (interpretation) there are inserted—

  • aspirin equivalent” means, in relation to a quantity of aloxiprin, the quantity of aspirin which is equal in weight to 81.25 per cent of that quantity of aloxiprin;
  • enema” means a preparation to be administered into the rectum as an aqueous or oily solution or suspension;
  • irrigation” means to bathe by means of the application of a fluid in a continuous stream;

In Schedule 3 to the principal order (which specifies classes of medicinal products which are not on the general sale list) the word “or”, occurring in paragraph (c), is deleted and after paragraph (d) there are added the following paragraphs—

(e) for use as enemas, or (f) for use wholly or mainly for irrigation of wounds or of the bladder, vagina or rectum.

Explanatory note

EXPLANATORY NOTE

This order amends the Medicines (Products Other Than Veterinary Drugs) (General Sale List) Order 1984 (referred to as “the principal order”) which specifies classes of medicinal products which can with reasonable safety be sold or supplied otherwise than by or under the supervision of a pharmacist (the general sale list) and classes of such products which can with reasonable safety be sold by means of automatic machines (the automatic machines section of the general sale list).

The amendments made by this order are as follows:

Article 2 adds a definition of the expression “aspirin equivalent” which occurs in a reference to the substance Aloxiprin in Table A in Schedules 1 and 2 to the principal order. This article also adds definitions of the expressions “enema” and “irrigation” which occur by virtue of the amendments made by this order to Schedule 3.

Article 3 adds certain substances to Tables A and B in Schedule 1 to the principal order (which lists substances used in medicinal products other than products the subject of a product licence of right, on general sale).

Article 4 deletes certain substances from Table A in Schedule 2 to the principal order (which lists substances used in medicinal products, the subject of a product licence of right, on general sale).

Article 4 also deletes the entry in Table A in Schedule 2 to the principal order relating to the substance listed as Sodium Polyhydroxyaluminium Monocarbonate Hexitol Complex and adds an entry in that Table for Alexitol Sodium, which is the British Approved Name for that substance, used in the list of names prepared in accordance with section 100 of the Medicines Act 1968.

Article 5 , by amendments to Schedule 3 to the principal order, excludes from the general sale list and the automatic machines section of the general sale list medicinal products which are promoted, recommended or marketed for use as enemas or for the irrigation of wounds or the irrigation of the bladder, vagina or rectum.
