The International Union for the Protection of New Varieties of Plants (Legal Capacities) Order 1985

Whereas a draft of this Order has been laid before Parliament in accordance with section 10(1) of the International Organisations Act 1968 (hereinafter referred to as the Act) and has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1 of the Act[^f00001] or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order may be cited as the International Union for the Protection of New Varieties of Plants (Legal Capacities) Order 1985 and shall come into operation on the day after the day on which it is made.

The International Union for the Protection of New Varieties of Plants (hereinafter referred to as the Organisation) is an organisation of which the United Kingdom and other sovereign Powers are members.

The Organisation shall have the legal capacities of a body corporate.

Explanatory note

EXPLANATORY NOTE

This Order confers the legal capacities of a body corporate on the International Union for the Protection of New Varieties of Plants. It gives effect to Article 24 of the International Convention for the Protection of New Varieties of Plants of 2nd December 1961 as revised at Geneva on 10th November 1972 and on 23rd October 1978 (Cmnd. 9152).
