The Non-metropolitan Counties (Local Statutory Provisions) Order 1986

The Secretary of State, in exercise of the powers conferred on him by section 262(9)(a) of the Local Government Act 1972 and of all other powers enabling him in that behalf, hereby makes the following order:—

This order may be cited as the Non-metropolitan Counties (Local Statutory Provisions) Order 1986 and shall come into operation on 4th August 1986.

The following local statutory provisions shall be exempt from repeal in pursuance of section 262(9) of the Local Government Act 1972—

• (a) section 7 of the Act of 1834 4 & 5 Will 4 c.xlvi (which relates to Poole Bridge)[^f00001];

• (b) sections 1, 2 and 78 of the Nottingham Corporation Act 1882;

• (c) sections 1, 3, 7(1) and (2)(a), 9, 13 to 15, 34, 35, 47, 50, 64 to 69 and 72 of and Schedule 1 to the Lindsey County Council (Sandhills) Act 1932;

• (d) sections 1(1), 4 and 147 of the Ipswich Corporation Act 1948;

• (e) sections 1, 3 to 23, 26, 28 to 46, 48 to 50 and 52 to 58 of and Schedules 1 and 2, paragraphs 1 to 5 and 14 to 41 of Schedule 3 and Schedule 4 to the Cheshire Brine Pumping (Compensation for Subsidence) Act 1952[^f00002];

• (f) sections 1, 4 to 13, 23, 24, 26 to 35, 38 and 40 to 42 of and Schedules 2 and 3 to the Letchworth Garden City Corporation Act 1962; and

• (g) sections 1, 3 to 9, 11 to 14 and 17 of and Schedules 1, 2 and 4 to the Eton Rural District Council Act 1971.

Explanatory note

EXPLANATORY NOTE

Section 262(9) of the Local Government Act 1972 provides that all local statutory provisions to which that sub-section applies were to cease to have effect on specified dates, but allows the date to be postponed in relation to any local authority area, or any provision to be exempted from that subsection, by statutory order.

The specified date in relation to non-metropolitan counties was postponed to 31st December 1986 by the Non-metropolitan and Welsh Counties (Local Statutory Provisions) Order 1983 (S.I. 1983/619).

This order exempts from repeal the local statutory provisions listed in article 2, which relate to places in non-metropolitan counties. Those provisions will therefore continue in force after 31st December 1986.
