The Rabies (Importation of Dogs, Cats and Other Mammals) (Amendment) Order 1986

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 10(1), (2), (3), (4) and (5) and 95(1) of the Animal Health Act 1981 and of all other powers enabling them in that behalf, for the purpose of preventing the introduction of rabies into Great Britain, hereby order as follows:—

Title and commencement

This order may be cited as the Rabies (Importation of Dogs, Cats and Other Mammals) (Amendment) Order 1986 and shall come into operation on 1st January 1987.

Amendment

The Rabies (Importation of Dogs, Cats and Other Mammals) Order 1974 [^f00001] shall be amended as follows:—

• (a) in Article 2(1) (interpretation) for the definition of “harbour” there shall be substituted the following definition:—

• “harbour” means any harbour, whether natural or artificial, and any port, haven, estuary, tidal or other river or inland waterway, and includes a dock, a wharf, any place at which hovercraft are loaded or unloaded and, in Scotland, a boatslip being a marine work within the meaning of section 57 of the Harbours Act 1964 [^f00002];

• (b) in Part I of Schedule 2 (ports at which authorised landings of animals may take place) for the words “Harwich, Navyard Wharf and Parkeston Quay” there shall be substituted the words “Harwich, Parkeston Quay”; and

• (c) in Part II of Schedule 2 (airports at which authorised landings of animals may take place) after “Manchester” there shall be inserted “Norwich”.

Explanatory note

EXPLANATORY NOTE

This order further amends the Rabies (Importation of Dogs, Cats and Other Mammals) Order 1974 (“the 1974 Order”) which, in order to prevent the introduction of rabies into Great Britain, prohibits the landing in Great Britain of certain animals, except under the authority of, and in accordance with conditions imposed by, a licence granted under it.

The changes of substance made by this order are:—

(a) the definition of “harbour” in the 1974 Order is amended so as to include all inland waterways and not only those navigated by seagoing ships (Article 2(a));

(b) Navyard Wharf, Harwich has been omitted from the list of ports at which authorised landings of animals may take place (Article 2(b)); and

(c) Norwich is added to the list of airports at which authorised landings of animals may take place (Article 2(c)).
