The Secretary of State for Transport, being a Minister designated[^f00001] for the purpose of section 2(2) of the European Communities Act 1972 in relation to the regulation and supervision of working conditions of persons engaged in road transport and the regulation of the type, description, construction or equipment of vehicles, in exercise of the powers conferred by that section, hereby makes the following Regulations:—

These Regulations may be cited as the Passenger and Goods Vehicles (Recording Equipment) (Amendment) Regulations 1986 and shall come into operation on 31st December 1986.

In these Regulations “the 1979 Regulations” means the Passenger and Goods Vehicles (Recording Equipment) Regulations 1979[^f00002]

The 1979 Regulations shall be further amended by substituting for paragraph (2A) of regulation 4 the following paragraph:—

(2A) (a) An approval or nomination shall be issued— (i) in the case of an approval or nomination issued between 31st October and 31st December in any year, for a period ending on 31st January in the Second year following the year of issue, and (ii) in the case of any other approval or nomination, for a period ending on 31st January in the year following the year of issue. (b) An approval or nomination issued and not withdrawn may, on application before the date of its expiry, be renewed for a further period ending on 31st January next following and thereafter for successive periods so ending.

The Passenger and Goods Vehicles (Recording Equipment) (Amendment) Regulations 1985 is hereby revoked.

Explanatory note

EXPLANATORY NOTE

These Regulations further amend the Passenger and Goods Vehicles (Recording Equipment) Regulations 1979 to provide that approvals or nominations issued under Regulation 4 of those Regulations shall expire on 31st January in any year rather than 31st December, and that subsequent renewals from year to year shall run to 31st January (regulation 3). Transitional provisions (regulation 4) extend existing approvals and nominations for a month.
