The Precept Limitation (Passenger Transport Authorities) (Prescribed Maximum) Order 1986

Made: 12th February 1986

Coming into Operation: 14th February 1986

Whereas by virtue of section 68(6) of the Local Government Act 1985 the authorities listed in the Schedule to this Order are deemed to have been designated under section 2 of the Rates Act 1984 in relation to the financial year beginning on 1st April 1986;

And whereas the Secretary of State has served notice on each of those authorities pursuant to section 4(1) of the said Act of 1984 stating the maximum which he proposes to prescribe under section 1 of that Act for the precept issued by them for that year;

And whereas none of those authorities has accepted the maximum proposed by the Secretary of State within the period specified in the notice or agreed with him a different maximum;

And whereas a draft of this Order has been approved by resolution of the House of Commons:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by sections 1 and 4(4) of the Rates Act 1984, and of all other enabling powers, hereby makes the following Order:—

Title and commencement

This Order may be cited as the Precept Limitation (Passenger Transport Authorities) (Prescribed Maximum) Order 1986 and shall come into operation on 14th February 1986.

Interpretation

In this Order—

• “the Act” means the Rates Act 1984; and

• “the maximum precept” means a maximum amount in the pound for the precept.

Prescription of maximum precepts

There is hereby prescribed under section 1 of the Act, for the financial year beginning on 1st April 1986, as the maximum precept for an authority listed in the Schedule to this Order, the amount there set against the name of the authority.
