The Non-Contentious Probate Fees (Amendment) Order 1987

Made: 30th June 1987

Laid before Parliament: 10th July 1987

Coming into force: 1st August 1987

The Lord Chancellor, in exercise of the powers conferred on him by section 130 of the Supreme Court Act 1981[^f00001], and with the concurrence of the Lord Chief Justice, the Master of the Rolls, the President of the Family Division, the Vice-Chancellor and the Treasury, hereby makes the following Order:

This Order may be cited as the Non-Contentious Probate Fees (Amendment) Order 1987 and shall come into force on 1st August 1987.

For paragraph 1(a) of the Schedule to the Non-Contentious Probate Fees Order 1981[^f00002] there shall be substituted the following sub-paragraph—

(a) if the assessed value - does not exceed £10,000No fee - exceeds £10,000 but does not exceed £25,00040.00 - exceeds £25,000 but does not exceed £40,00080.00 - exceeds £40,000 but does not exceed £70,000150.00 - exceeds £70,000 but does not exceed £100,0002.50 per £1,000 - or part thereof

The Non-Contentious Probate Fees (Amendment) Order 1983[^f00003] is hereby revoked.

Explanatory note

(This note is not part of the Order)

This Order substitutes a fixed fee of £150 for the ad valorem charge of £2.50 per £1,000 or part thereof in respect of estates with an assessed value exceeding £40,000 and not exceeding £70,000.
