The Secretary of State for Transport, in exercise of the powers conferred by section 19(7) of the Transport Act 1985[^f00001], and of all other enabling powers, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Section 19 Minibus (Designated Bodies) Order 1987 and shall come into force on 13th August 1987.

Interpretation

In this Order, “the Act” means the Transport Act 1985.

Every designated body shall send to the traffic commissioner for the traffic area in which the principal administration of the body to which the permit is granted is carried on:

within one month of the grant, variation or revocation as the case may be.

2 Every Passenger Transport Executive established under section 9(1) of the Transport Act 1968[^f00005]. Bodies which the designated body assists in pursuance of its duty under section 9A of the Transport Act 1968[^f00006] with respect to the provision of public passenger transport services wholly or mainly to meet the transport needs of members of the public who are elderly or disabled.
3 The council of every metropolitan district established under section 1(3) of the Local Government Act 1972. a Bodies to whom the designated body may make grants under section 65 of the Health Services and Public Health Act 1968. b Schools or bodies which fulfil the duty of the designated body under the Education Act 1944 with respect to the provision of education, and bodies connected with such schools or bodies. c Bodies which assist and co-ordinate activities of community bodies within the area of the council.
4 The council of every district in a non-metropolitan county established under section 1(4) of the Local Government Act 1972. a Bodies which operate wholly or mainly within the area of the council and whose purpose is to promote social welfare. b Bodies which assist and co-ordinate activities of community bodies within the area of the council.
5 The council of every outer London borough established under the London Government Act 1963[^f00007]. a Bodies to whom the designated body may make grants under section 65 of the Health Services and Public Health Act 1968. b Schools or bodies which fulfil the duty of the designated body under the Education Act 1944 with respect to the provision of education, and bodies connected with such schools or bodies. b Bodies which assist and co-ordinate activities of community bodies within the area of the council.
6 The council of every inner London borough established under the London Government Act 1963. a Bodies to whom the designated body may make grants under section 65 of the Health Services and Public Health Act 1968. b Bodies which assist and co-ordinate activities of community bodies within the area of the council.
7 The Common Council of the City of London. a Bodies to whom the designated body may make grants under section 65 of the Health Services and Public Health Act 1968. b Bodies which assist and co-ordinate activities of community bodies within the area of the council.
8 The Inner London Education Authority Schools or bodies which fulfil the duty of the designated body under the Education Act 1944 with respect to the provision of education, and bodies connected with such schools or bodies.
9 The council of every region established under section 1(2) of the Local Government (Scotland) Act 1973[^f00008]. a Bodies connected with the fulfilment of any duty imposed on the designated body by the Social Work (Scotland) Act 1968[^f00009]. b Schools or other educational establishments which fulfil the duty of the designated body under the Education (Scotland) Act 1980[^f00010] with respect to the provision of education, and bodies connected with such schools or educational establishments. c Bodies which assist and co-ordinate activities of community bodies within the area of the council.
10 The council of every district established under section 1(4) of the Local Government (Scotland) Act 1973. Community councils within the area of the designated body.
11 The council of each of the Orkney, Shetland and the Western Isles islands areas. a Bodies connected with the fulfilment of any duty imposed on the designated body by the Social Work (Scotland) Act 1968. b Schools or other educational establishments which fulfil the duty of the designated body under the Education (Scotland) Act 1980, with respect to the provision of education, and bodies connected with such schools or educational establishments. c Community councils within the area of the designated body. d Bodies which assist and co-ordinate activities of community bodies within the area of the council.

Explanatory note

(This note is not part of the Order)

By this Order, the Secretary of State for Transport designates the bodies which may grant permits in relation to the use of small buses under section 19 of the Transport Act 1985 (article 3(1) and Schedule). It replaces the Minibus (Designated Bodies) Order 1980 (S.I. 1980/1356) which had effect by virtue of section 42 of the Public Passenger Vehicles Act 1981 (c. 14). That order has lapsed with the repeal of that section by Schedule 8 of the Transport Act 1985 (Transport Act 1985 (Commencement No. 7) Order 1987, S.I. 1987/1228). Traffic commissioners may grant similar permits. A designated body may grant a permit to itself and to the bodies specified in relation to it in the Schedule (article 3(2)). Article 4 requires each designated body to make returns in respect of permits granted by it.
