Made: 14th October 1987

Coming into force: 15th October 1987

The Secretary of State for the Environment, in exercise of the powers conferred by sections 23, 32(1) and 59(1)[^f00001] of the Water Act 1945[^f00002] and now vested in him[^f00003] and of all other powers enabling him in that behalf, hereby makes the following Order:—

Interpretation

In this Order—

Power to acquire, continue and maintain works

The Authority may acquire by agreement and thereafter continue and maintain the mains, pipes and apparatus the approximate positions of which are shown by continuous and broken blue lines on the deposited plan.

Works to form part of the undertaking

The mains, pipes and appartus acquired by the Authority in pursuance of this Order shall for all purposes form part of the undertaking and for the purposes of the Third Schedule as applied to the undertaking shall be deemed to have been laid or constructed by the Authority for the purpose of giving a general supply of water.

Application of section 94 of the Third Schedule

Section 94 of the Third Schedule shall apply to the undertaking and is hereby incorporated with this Order, subject to the modification that in subsection (1)[^f00004] for the words from “metropolitan district” to the end of the subsection there shall be substituted the words “and non-metropolitan district affected by the special Act”.
