The Medicines (Exemptions from Restrictions on the Retail Sale or Supply of Veterinary Drugs) (Amendment) (No.2) Order 1987

The Secretary of State concerned with health in England, the Secretaries of State respectively concerned with health and with agriculture in Scotland and in Wales, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of the powers conferred by sections 1, 57(1), (2) and (2A) and 129(4) of the Medicines Act 1968[^f00001] and now vested in them[^f00002], and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following Order in accordance with section 129(6) of that Act and with the consent of the Treasury in accordance with section 57(2A) of that Act, hereby make the following Order:

Title, commencement and interpretation

• (1) This Order may be cited as the Medicines (Exemptions from Restrictions on the Retail Sale or Supply of Veterinary Drugs) (Amendment) (No.2) Order 1987 and shall come into force on 1st January 1988.

• (2) In this Order “the principal Order” means the Medicines (Exemptions from Restrictions on the Retail Sale or Supply of Veterinary Drugs) Order 1985[^f00003].

Amendment of the principal Order

The principal Order shall be amended in accordance with articles 3 to 6 below.

In article 3 (exemption for merchants in veterinary drugs) there shall be substituted–

• (a) in paragraph (11)(a) for the amount “£125.00” the amount “£130.00”;

• (b) in paragraph (11)(b) for the amount “£88.00” the amount “£91.00”;

• (c) in paragraph (11)(c) for the amount “£145.00” the amount “£150.00”.

In article 5 (exemptions for merchants in horse wormers)–

• (a) in paragraph (1) the words from “during the period” to “of this order” shall be omitted;

• (b) in paragraph (10) there shall be substituted–

• (i) in sub-paragraph (a) for the amount “£30.00” the amount “£53.00”;

• (ii) in sub-paragraph (b) for the amount “£29.00” the amount “£53.00”;

• (iii) in sub-paragraph (c) for the amount “£60.00” the amount “£100.00”.

For Part B of Schedule 1 (veterinary drugs sold by merchants) there shall be substituted the provisions set out in Schedule 1 to this Order.

For Part B of Schedule 2 (veterinary drugs for incorporation in animal feeding stuffs) there shall be substituted the provisions set out in Schedule 2 to this Order.

Explanatory note

(This note is not part of the Order)

This Order further amends the Medicines (Exemptions from Restrictions on the Retail Sale or Supply of Veterinary Drugs) Order 1985.

The Order removes the deadline of 31st December 1987 for the exemptions for merchants in horse wormers (article 4(a)).

The Order increases the fees payable–

• (a) by a merchant in veterinary drugs in respect of each premises for the entry of his name in the relevant register from £125 to £130, for the retention of his name in that register from £88 to £91 and for the restoration of his name to that register from £145 to £150 (article 3);

• (b) by a merchant in horse wormers in respect of each premises for the entry of his name in the relevant register from £30 to £53, for the retention of his name in that register from £29 to £53 and for the restoration of his name to that register from £60 to £100 (article 4(b)).

The Order also substitutes updated provisions for Part B of Schedule 1 (veterinary drugs sold by merchants) and Part B of Schedule 2 (veterinary drugs for incorporation in animal feeding stuffs) (articles 5 and 6 and Schedules). Certain items, shown in italics in the new provisions, have been inserted in those Schedules and certain other items have been deleted.
