The Fishguard-Bangor (Menai Suspension Bridge) Trunk Road (Cardigan By-pass) Order 1987

Made: 14th December 1987

Coming into force: 20th January 1988

The Secretary of State for Wales makes this Order in exercise of powers conferred by sections 10, 12, 41 and 106 of the Highways Act 1980[^f00001] and of all other enabling powers:—

The new highway which the Secretary of State proposes to construct along the route described in Schedule 1 to this Order shall become a trunk road as from the date when this Order comes into force.

The centre line of the new trunk road is indicated by a heavy black line on the deposited plan.

The Secretary of State directs as respects any part of a highway which crosses the route of the new trunk road that —

• (a) where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

• (b) where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question;

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purposes of through traffic.

The lengths of Trunk Road described in Schedule 2 to this Order shall cease to be a trunk road and shall be classified as classified roads as from the date on which the Secretary of State notifies the County Council of Dyfed that the new trunk road is open for through traffic.

The Secretary of State is authorised to construct the bridge specified in Schedule 3 to this Order as part of the new trunk road.

In this Order —

• (i) “the deposited plan” means the Plan numbered HA10/2 WO62, marked “The Fishguard-Bangor (Menai Suspension Bridge) Trunk Road (Cardigan By-Pass) Order 1987”, signed by authority of the Secretary of State and deposited at the Welsh Office, Curran Embankment Respository, Curran Embankment, Cardiff, where it is open to inspection free of charge at all reasonable hours;

• (ii) “the new trunk road” means the highway mentioned in Article 1 of this Order;

• (iii) “classified roads” as a classification for a highway, means that the highway is a classified road for the purposes of enactments and instruments which refer to highways classified as classified roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;

• (iv) “the Trunk Road” means the Fishguard-Bangor (Menai Suspension Bridge) Trunk Road (A487).

This Order shall come into force on the 28th January 1988 and may be cited as The Fishguard-Bangor (Menai Suspension Bridge) Trunk Road (Cardigan By-pass) Order 1987.

SCHEDULE 1 — ROUTE OF THE NEW TRUNK ROAD

The route of the new trunk road in the Town of Cardigan in the County of Dyfed is a route approximately 2.05 kilometres in length commencing at a point on the Trunk Road (marked "A" on the deposited plan) about 25 metres north of the south-east corner of No. 18 Ridgeway, and extending in a north-easterly direction to a point on the trunk road (marked "B" on the deposited plan) 20 metres east of the south-east corner of the junction of New Mill Road with the Trunk Road all in the Town of Cardigan and County of Dyfed.

SCHEDULE 2 — LENGTH OF TRUNK ROAD CEASING TO BE A TRUNK ROAD

The lengths of the Trunk Road ceasing to be a trunk road are those lengths between the points marked "A" and "B" on the deposited plan described in Schedule 1 above and shown on the deposited plan by broad striped hatching all in the Town of Cardigan and County of Dyfed.
