The Movement and Sale of Pigs (Amendment) Order 1987
Made: 17th February 1987
Coming into force: 10th March 1987
The Minister of Agriculture, Fisheries and Food and the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 7(1), 8(1) and 25 of the Animal Health Act 1981[^f00001] and of all other powers enabling them in that behalf, order as follows:—
Title and commencement

This Order may be cited as the Movement and Sale of Pigs (Amendment) Order 1987 and shall come into force on 10th March 1987.
Amendment

The Movement and Sale of Pigs Order 1975[^f00002] shall be amended as follows:—
- (a) at the end of article 2(3) (movements of pigs exempt from movement restrictions) there shall be added the following sub-paragraph:—
(f) movement of pigs for breeding purposes under the authority of a licence issued under article 5 of this Order, being a licence in the form set out in Schedule 4, and the return home of those pigs under the authority of such a licence.
- (b) in article 5(3) (licences for movements of pigs)—
- (i) after the words “to which the licence is to relate” there shall be inserted the words “or his agent authorised in writing for this purpose”; and
- (ii) after the words “at which the mating is to take place” there shall be inserted the words “or his agent authorised in writing for this purpose”; and
- (c) for Schedule 5 (form of declarations to be made before a licence for the movement of pigs will be issued) there shall be substituted the Schedule to this Order.
SCHEDULE 5 — THE MOVEMENT AND SALE OF PIGS ORDER 1975
PART I
declaration to be made by owner of pigs (or his agent) for use in case of a licensed movement of pigs (other than a licensed movement from a market, fairground, saleyard or licensed collecting centre, artificial insemination centre, performance testing station, exhibition or show)
PART II
additional declaration to be made by occupier of premises at which mating is to take place (or his agent) for use in case of a licensed movement of pigs for breeding purposes

Explanatory note
(This note is not part of the Order)
This Order amends the Movement and Sale of Pigs Order 1975 (“the 1975 Order”) which, amongst other provisions, contains a prohibition on the movement of pigs from any premises within 21 days of the movement of any pigs on to those premises, subject to certain specified exemptions. The Order adds a further exemption to such prohibition where pigs are moved for breeding purposes under the authority of a licence in the form set out in Schedule 4 to the 1975 Order issued under article 5 of that Order (article 2(a)).
The Order also amends the form of the declarations required to be made before a licence is issued under article 5 of the 1975 Order authorising the movement of pigs from any premises (article 2(c)), the movement of pigs from all premises being subject to licensing control under the 1975 Order, with the exception of certain specified movements. A person making such a declaration is now required to declare that no pigs on his premises have been fed or brought into contact with any waste food (including waste food originating from his own household) during the previous three months.
