The Potato Marketing Scheme (Amendment) Order 1987
Made: 23rd February 1987
Coming into force: 1st March 1987
Now, therefore, the Ministers, acting jointly, in exercise of the powers conferred by section 2 of, and Schedule 1 to, the Agricultural Marketing Act 1958[^f00002], and now vested in them[^f00003], hereby make the following Order:

This Order may be cited as the Potato Marketing Scheme (Amendment) Order 1987.

The amendments of the Potato Marketing Scheme 1955 which are set out in the Schedule hereto are hereby approved and shall come into force on 1st March 1987.
SCHEDULE
1
In paragraph 83(1)(a), for the words “two hundred pounds” there shall be substituted the words “two thousand pounds”.

In paragraph 84(2)(b), for the words “five times the formula rate as defined in paragraph 84(3)(a)”, there shall be substituted the words “seven times the formula rate with effect from 1st March 1987 and ten times the formula rate with effect from 1st January 1989”.

Explanatory note
(This note is not part of the Order)
This Order approves further amendments of the Potato Marketing Scheme 1955, (“the Scheme”).
The amendments—
- (a) increase the maximum monetary penalty which the Disciplinary Committee may impose on any registered producer under the provisions of paragraph 83(1)(a) of the Scheme from two hundred to two thousand pounds;
- (b) increase the maximum excess area contribution provided for in paragraph 84(2)(b) of the Scheme, which is currently fixed at five times the formula rate (as defined in paragraph 84(3)(a) of the Scheme) as follows—
- (i) with effect from 1st March 1987 to seven times the formula rate;
- (ii) with effect from 1st January 1989 to ten times the formula rate.
