The Public Utility Transfers and Water Charges Act 1988 (Commencement No. 2) Order 1988

Made: 5th July 1988

The Secretary of State, in exercise of his powers under section 8(2) of the Public Utility Transfers and Water Charges Act 1988[^f00001] (hereinafter referred to as “the Act”), hereby makes the following Order:

This Order may be cited as the Public Utility Transfers and Water Charges Act 1988 (Commencement No. 2) Order 1988.

• (1) The provisions of the Act specified in the Schedule to this Order shall come into force on 1st October 1988.

• (2) All other provisions of the Act not already in force shall come into force on 1st April 1989.

Explanatory note

(This note is not part of the Order)

This Order brings into force on 1st October 1988 the following provisions of the Public Utility Transfers and Water Charges Act 1988, together with related amendments —

Section 3(6) and (7), which provides for liability for charges after ceasing to occupy metered premises; and

Section 5(1), to the extent that it gives effect to the following provisions of Schedule 1:—

• (a) paragraph 6 (expenses connected with meter installation);

• (b) paragraphs 7 and 8 (tampering with meters, and undertakers' duty to inform other undertakers of meter readings);

• (c) paragraph 9 (arbitration).

Paragraphs 6 and 9 of Schedule 1 are only brought into force partially.

This Order also brings into force on 1st April 1989 the remaining provisions of the 1988 Act not already in force, that is to say section 5(1) to the extent that it gives effect to the following provisions of Schedule 1:—

• (a) paragraph 1, which enables undertakers to impose conditions of new supply;

• (b) paragraph 2(9), which concerns undertakers' powers to carry out works to facilitate metering; and

• (c) paragraphs 6 and 9, which provide for expenses connected with meter installation and arbitration, to the extent that they are not already in force.

The other provisions of the Act, so far as they were not brought into force by the Act itself, were brought into force by the Public Utility Transfers and Water Charges Act 1988 (Commencement No. 1) Order 1988 (S.I. 1988/879) on 18th May or 11th July 1988.
