The Reciprocal Enforcement of Foreign Judgments (Canada) (Amendment) Order 1988

At the Court at Buckingham Palace, the 26th day of July 1988 Present, The Queen’s Most Excellent Majesty in Council

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1 of the said Act and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order shall come into force on 17th September 1988 and may be cited as the Reciprocal Enforcement of Foreign Judgments (Canada) (Amendment) Order 1988.

The Reciprocal Enforcement of Foreign Judgments (Canada) Order 1987[^f00003] shall be amended by adding in article 3 (which names the Canadian courts, including the courts of Provinces, which are to be recognised courts for the purposes of Part I of the Foreign Judgments (Reciprocal Enforcement) Act 1933) after “Ontario”, the words “, Prince Edward Island”.

SCHEDULE — Canadian declaration extending to Prince Edward Island the Convention between Canada and the United Kingdom of Great Britain and Northern Ireland Providing for the Reciprocal Recognition and Enforcement of Judgments in Civil and Commercial Matters

Pursuant to Article XII, the Government of Canada declares that in addition to the provinces of British Columbia, Manitoba, New Brunswick, Nova Scotia, Ontario and the Yukon Territory, the Convention shall extend to the province of Prince Edward Island. An application in the province of Prince Edward Island for the registration of a judgment given by a court of the United Kingdom may be made in the Supreme Court of the province of Prince Edward Island, Trial Division.

Explanatory note

(This note is not part of the Order)

This Order amends article 3 of the Reciprocal Enforcement of Foreign Judgments (Canada) Order 1987 so as to include the courts of the Province of Prince Edward Island as recognised courts.
