The Dock Workers (Regulation of Employment) (Amendment) Order 1988

Coming into force: 5th September 1988

Now, therefore, the Secretary of State in exercise of the powers conferred by section 2(5) and (6) of the Act and now vested in him[^f00004], and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

This Order may be cited as the Dock Workers (Regulation of Employment) (Amendment) Order 1988 and shall come into force on 5th September 1988.

Variation of the principal scheme

Effect is hereby given to the Dockworkers (Regulation of Employment) (Amendment) Scheme 1988 set out in the Schedule hereto and the principal scheme shall be varied accordingly.

SCHEDULE — THE DOCK WORKERS (REGULATION OF EMPLOYMENT) (AMENDMENT) SCHEME 1988

This scheme shall be called the Dock Workers (Regulation of Employment) (Amendment) Scheme 1988.

The principal scheme shall be varied in accordance with the succeeding paragraph of this Schedule.

In Clause 1 of the principal scheme (which sets out the name, objects and application of the scheme) for sub-paragraph (b) of paragraph (3) there shall be substituted the following sub-paragraph:—

(b) at the Port of Hunterston it shall apply to the handling of ore and coal, and other commodities the handling of which is compatible with the handling of ore and coal, except work by employees of the British Steel Corporation, or of the company nominated for the purposes of section 1 of the British Steel Act 1988[^f00005] (“the successor company”), manning cranes or manning the stockyard in respect of the ore or coal of the British Steel Corporation or of the successor company.

Explanatory note

(This note is not part of the Order)

This Order amends the Dock Workers (Regulation of Employment) Scheme 1947, as varied in 1960, 1961, 1967, and 1980. The 1947 Scheme as varied is set out in Schedule 2 to the Dock Workers (Regulation of Employment) (Amendment) Scheme 1967 and is now known as the Dock Workers Employment Scheme 1967 (“the 1967 Scheme”). Paragraph (3) of Clause 1 of the 1967 Scheme was amended by paragraph 3 of the Schedule to the Dock Workers (Regulation of Employment) (Amendment) Order 1980.

This Order varies the application of the 1967 Scheme so that on the transfer of the property, rights and liabilities of the British Steel Corporation to the successor company under the British Steel Act 1988, the Scheme shall continue not to apply to certain work at the Port of Hunterston.
