The Local Government (Direct Labour Organisations) (Competition) (Amendment) Regulations 1988

The Secretary of State for the Environment, in relation to England, and the Secretary of State for Wales, in relation to Wales, in exercise of the powers conferred on them by sections 7 and 9(3) of the Local Government, Planning and Land Act 1980[^f00001] and of all other powers enabling them in that behalf, hereby make the following Regulations:

These Regulations may be cited as the Local Government (Direct Labour Organisations) (Competition) (Amendment) Regulations 1988 and shall come into force on 1st April 1988.

The Local Government (Direct Labour Organisations) (Competition) Regulations 1983[^f00002] are hereby further amended by the substitution of“40%” for“70%” in Regulations 6(2)(a) and 8(2)(a).

Explanatory note

(This note is not part of the Regulations)

These Regulations amend the Local Government (Direct Labour Organisations) (Competition) Regulations 1983 in their application to highway work.

The 1983 Regulations apply competitive tendering requirements to certain highway works contracts and highway functional work worth £25,000 or less if the value of the contract or work and the value of all similar work worth £25,000 or less previously contracted for or done by the authority in the current financial year exceeds a prescribed percentage of the total value of similar work contracted for or done in the previous year.

These Regulations vary the prescribed percentage from 70% to 40%.
