The Lowestoft (Pilotage) Harbour Revision Order 1988

The Secretary of State for Transport in exercise of the powers conferred by section 14 of the Harbours Act 1964[^f00001]and now vested in him[^f00002], and of all other powers enabling him in that behalf, and on the application of Associated British Ports in accordance with section 7(5) of the Pilotage Act 1987[^f00003], hereby makes the following Order:—
Citation and commencement

This Order may be cited as the Lowestoft (Pilotage) Harbour Revision Order 1988 and shall come into force on 1st October 1988.
Interpretation

In this Order —
- “the existing area of jurisdiction” means the area comprised in the limits of the port of Lowestoft;
- “the signed plan” means the plan signed in triplicate by an Under Secretary in the Department of Transport, two copies of which have been deposited at that Department and one copy of which has been deposited at the offices of the Port Manager at Port House, Lowestoft, Suffolk.
Extension of limits of jurisdiction for purposes of pilotage

The limits within which Associated British Ports shall have jurisdiction for the purposes of pilotage under Part I of the Pilotage Act 1987 shall include (in addition to the existing area of jurisdiction) the area the boundaries of which are shown by a continuous red line on the signed plan, being an area of the sea bounded—
- (a) on the north, by an imaginary line drawn true east from a point on the level of high water on the parallel of latitude 52°31'5.N until it reaches longitude 1°50'.E;
- (b) on the east, by an imaginary line following the said longitude in a southerly direction until it intersects the next mentioned line;
- (c) on the south, by an imaginary line drawn true east from a point on the level of highwater on the parallel of latitude 52°26'.1N, until it intersects with the last mentioned line;
- (d) on the west, by the level of high water on the boundary of the existing area of jurisdiction as the case may be.

Explanatory note
(This note is not part of the Order)
By virtue of section 7(5) of the Pilotage Act 1987 a direction given by a harbour authority for the purpose of making pilotage compulsory for ships navigating in a specified area shall not apply to any area which is outside the Authority’s harbour unless the limits of jurisdiction of the authority for pilotage purposes have been extended to cover that area.
This Order accordingly extends the limits of jurisdiction of Associated British Ports, as Harbour Authority for Lowestoft, for pilotage purposes under Part I of the Pilotage Act 1987 so as to include an area outside the harbour in respect of which Associated British Ports considers that pilotage should be compulsory.
The applicant for this Order is Associated British Ports.
