The Local Government Reorganisation (Property) (No.2) (West Yorkshire) Order 1988

Laid before Parliament: 17th October 1988

Coming into force: 7th November 1988

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:—

This Order may be cited as the Local Government Reorganisation (Property) (No.2) (West Yorkshire) Order 1988 and shall come into force on 7th November 1988.

There shall vest in each local authority mentioned in the Schedule to this Order —

• (a) all interests of the West Yorkshire Residuary Body in the property so mentioned in relation to that local authority; and

• (b) all rights and liabilities of that Body acquired or incurred exclusively in connection with that property.

SCHEDULE — LAND TRANSFERRED TO LOCAL AUTHORITIES

A. BRADFORD CITY COUNCIL

B. CALDERDALE METROPOLITAN BOROUGH COUNCIL

A parcel of land consisting of approximately 0.29 acres between New Bank and Godley Road, Northowram.

The sites of 1 and 3 Denholme Buildings, Burnley Road, Luddendenfoot, Sowerby Bridge.

C. KIRKLEES METROPOLITAN BOROUGH COUNCIL

Other Property

The Highways Office, 21 Blakeridge Lane, Batley and the Office’s car park, Blakeridge Lane.

D. LEEDS CITY COUNCIL

Other Property

The offices, laboratories, garages, caretaker’s house, car park and grounds together known as the Materials Testing Laboratory, Sowood Lane, Ossett, Wakefield.

Spring Lane Sidings, East Ardsley, consisting of approximately 27.17 acres of land between east of Fall Lane and Lingwell Gate Lane and lying to the south of the Leeds-London railway line.

A triangular parcel of land consisting of approximately 650 square yards between Park Lane and Westgate, Leeds, opposite Titan House.

Explanatory note

(This note is not part of the Order)

The Local Government Reorganisation (Property) (West Yorkshire) Orders 1987 and 1988 (S.I. 1987/15, 1451 and 1988/751) transferred specified property formerly vested in West Yorkshire County Council and in the West Yorkshire Residuary Body to certain of the district councils in that county. This Order makes further transfers of the same kind.

With one exception, article 2 transfers the property described in the Schedule, together with ancillary rights and liabilities, from the Residuary Body to the council of the district in which the property is situated. The exception relates to the Materials Testing Laboratory, Ossett, Wakefield, which is transferred to Leeds City Council.
