The Diseases of Fish (Definition of Infected) Order 1988

The Minister of Agriculture, Fisheries and Food in relation to England, and any marine waters adjacent to England, the Secretary of State for Scotland in relation to Scotland (including the marine waters thereof) and the Secretary of State for Wales in relation to Wales, and any marine waters adjacent to Wales, in exercise of the powers conferred on them by section 13(1) of the Diseases of Fish Act 1937[^f00001], and of all other powers enabling them in that behalf, hereby make the following Order:—

Title and commencement

This Order may be cited as the Diseases of Fish (Definition of “Infected”) Order 1988 and shall come into force on 10th March 1988.

Amendment of definition of “infected” in Diseases of Fish Act 1937

In the definition of “infected” in section 10(1) of the Diseases of Fish Act 1937[^f00002], after the words “furunculosis of salmon,” there shall be inserted the words “gyrodactyliasis caused by Gyrodactylus salaris,”.

Revocation

The Diseases of Fish Order 1966[^f00003] is hereby revoked.

Explanatory note

(This note is not part of the Order)

This Order amends the list of diseases to which the provisions of the Diseases of Fish Act 1937, as amended, apply.

The Order amends the definition of “infected” in section 10(1) of the Act by adding gyrodactyliasis caused by the parasite Gyrodactylus salaris to the list of diseases in that section (article 2).

The Order revokes the Diseases of Fish Order 1966, which has ceased to have effect (article 3).
