Coming into force: On a date to be notified in the London, Edinburgh and Belfast Gazettes

At the Court at Buckingham Palace, the 17th day of February 1988 Present, The Queen’s Most Excellent Majesty in Council

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1 of the Act[^f00002] or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

This Order may be cited as the International Trust Fund for Tuvalu (Immunities and Privileges) Order 1988 and shall come into force on the date on which the provisions of article 5 of the Agreement between the Government of the United Kingdom and the Governments of Australia, New Zealand and Tuvalu concerning the International Trust Fund for Tuvalu signed at Suva on 16th June 1987[^f00003] becomes effective for the four Governments. This date shall be notified in the London, Edinburgh and Belfast Gazettes.

The International Trust Fund for Tuvalu (hereinafter referred to as the Organisation) is an organisation of which the United Kingdom and other sovereign Powers are members.

The Organisation shall have the legal capacity of a body corporate.

Within the scope of its official activities, the Organisation shall have exemption from taxes on income and capital gains.

Explanatory note

(This note is not part of the Order)

This Order confers the legal capacities of a body corporate and exemption from direct taxes on the International Trust Fund for Tuvalu. It gives effect to article 5 of the Agreement between the United Kingdom, Australia, New Zealand and Tuvalu concerning the International Trust Fund for Tuvalu signed at Suva on 16th June 1987.
