The County Council of Isle of Wight New Yar Bridge Scheme 1985 Confirmation Instrument 1988

Made: 15th March 1988

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980[^f00001], and now vested in him[^f00002], and of all other enabling powers:

The County Council of Isle of Wight New Yar Bridge Scheme 1985 is hereby confirmed with modifications.

The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme with its accompanying plans as modified are deposited at the offices of the Secretary of State for Transport, and at the offices of the County Council of Isle of Wight at County Hall, Newport, Isle of Wight.

The Scheme will become operative on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

The Instrument may be cited as the County Council of Isle of Wight New Yar Bridge Scheme 1985 Confirmation Instrument 1988.

THE SCHEDULE TO THE INSTRUMENT — THE COUNTY COUNCIL OF ISLE OF WIGHT

The County Council of Isle of Wight (hereinafter referred to as “the Council”) make this Scheme in exercise of their powers under section 106 of the Highways Act 1980 and of all other enabling powers.

The Council are authorised to construct over the navigable waters of the River Yar the bridge specified in the Schedule to this Scheme as part of the highway they are proposing to construct between the River Road (A3054) and Bridge Road (A3054) at the western side of the River Yar in the Borough of South Wight in the County of Isle of Wight.

This Scheme may be cited as “The County Council of Isle of Wight New Yar Bridge Scheme 1985”.

THE SCHEDULE TO THE SCHEME — Plans and specifications of New Bridge over River Yar at Yarmouth

The site and general design of the Bridge are shown on plans numbered RR/104/40B and 2951/101 respectively, annexed hereto.

Explanatory note

(This Note is not part of the Instrument)

This Instrument confirms the County Council of Isle of Wight New Yar Bridge Scheme 1985 with minor modifications. They are—

• (a) In the Schedule, under the words “Plans and specifications of New Bridge over the River Yar at Yarmouth”, for “2952/PO1” is substituted “2952/101” and, under the word “Headway”, for “2.5 metres” is substituted “2.159 metres” (so that it accords with the numbering of, and detail on the general design plan).

• (b) On the site plan numbered RR/104/40B (annexed to this Scheme), for the title “Yarmouth Quay Approach — Proposed New Bridge and Approach Roads” is substituted the title “The County Council of Isle of Wight New Yar Bridge Scheme 1985 (Modified)”.

• (c) On the general design plan numbered 2951/101 (annexed to this Scheme), is inserted the title “The County Council of Isle of Wight New Yar Bridge Scheme 1985 (Modified)”.
