The Secretary of State, in exercise of the powers conferred on him by section 16(1), (1A)(e) and (5)(a) of the Plant Varieties and Seeds Act 1964 [^f00001], and of all other powers enabling him in that behalf, after consultation with representatives of such interests as appear to him to be concerned, hereby makes the following Regulations:

Citation, commencement and extent

Revocation of previous Regulations

The Seed Potatoes (Fees) (Scotland) Regulations 1987 [^f00002] are hereby revoked.

Payment of fees

There shall be paid in advance in respect of the matters arising under the Seed Potatoes Regulations 1984 [^f00003] referred to in the Schedule hereto, or under any regulations amending or superseding them, the fees respectively specified in the second column of the said Schedule opposite the references to such matters.

The said fees shall be payable to the Secretary of State.

Exemptions

The Secretary of State may exempt any person or class of person or persons generally from compliance in whole or in part with the provisions of these Regulations in relation to payment of fees and any exemptions so made may be made subject to conditions.

Explanatory note

(This note is not part of the Regulations)

These Regulations, which apply to Scotland only and which revoke and supersede the Seed Potatoes (Fees) (Scotland) Regulations 1987, prescribe the fees payable in respect of certain matters arising under the Seed Potatoes Regulations 1984.

The fees for crop inspection of all classes have been increased by £3.00 per half hectare representing an increase of between 17% and 18%.

The fees for the provision of labels and seals have been increased to £1.50 and the reduced fee for returned unused labels has been increased from 40p to 50p. With the exception of the fee for the provision of labels with tie-holes and seals which has increased by 15% to £1.50 in line with the fee for labels without tie-holes, the increase is 25%.
