The Building (Amendment of Prescribed Fees) Regulations 1988

The Secretary of State, in exercise of the powers conferred on him by sections 1, 3, 16(10), 34, 35, 50(3) and 126[^f00001] of, and paragraphs 2, 5 and 10(c) of Schedule 1 to, the Building Act 1984[^f00002], and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Building (Amendment of Prescribed Fees) Regulations 1988 and shall come into force on 13th June 1988.

Amendment of the Building (Prescribed Fees etc.) Regulations 1985

The Building (Prescribed Fees etc.) Regulations 1985[^f00003] are amended as follows—

• (1) in Schedule 1 there shall be substituted—

• (a) for “£75” in paragraphs 2 and 5, “£80”, and

• (b) for Tables 1 and 2, the following Tables—

• (2) in Schedule 2 there shall be substituted—

• (a) in paragraph 1 for “£10”, “£30” and “£40” respectively, “£11”, “£33” and “£44”, and

• (b) for the Table in paragraph 2, the following Table—

Transitional Provisions

These Regulations shall not affect the application of the Building (Prescribed Fees etc) Regulations 1985 in relation to work in respect of which—

• (1) a building notice was given or full plans were deposited (under regulation 11 of the Building Regulations 1985[^f00004]); or

• (2) an initial notice or a public body’s notice was given (under section 47(1) or 54(1) of the Building Act 1984),

before 13th June 1988, notwithstanding that on or after that date a notice is or has been given, or plans are or have been deposited, in respect of substantially the same work.

Revocations

Regulations 2(3)(a) and (c) and (4) of the Building (Amendment of Prescribed Fees) Regulations 1986[^f00005] are hereby revoked.

Explanatory note

(This note is not part of the Regulations)

These Regulations amend the Building (Prescribed Fees etc) Regulations 1985 so as to increase the flat rate fees payable to a local authority—

• (1) by approximately 7% in respect of the erection of small domestic building and connected work (Schedule 1 to the 1985 Regulations), and

• (2) by approximately 10% in respect of the erection of certain garages, carports and the making of small extensions and alterations to domestic buildings (Schedule 2 to the 1985 Regulations).

Transitional provisions are contained in regulation 3. Regulation 4 revokes the provisions of the Building (Amendment of Prescribed Fees) Regulations 1986 which are superseded by these Regulations.
