The Forestry Commissioners, in exercise of the powers conferred on them by section 3(1), (2) and (4) of the Plant Health Act 1967[^f00001], and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

This Order may be cited as the Restriction on Movement of Spruce Wood (Amendment) Order 1988 and shall come into force on 28th June 1988.

Amendment of the Restriction on Movement of Spruce Wood Order 1982

The Restriction on Movement of Spruce Wood Order 1982[^f00002] shall be further amended by substituting for the Schedule thereto (areas in respect of which the movement of spruce wood is restricted) the following Schedule—

SCHEDULE

Column 1 Column 2
Counties Those parts of the counties within which restrictions apply
Avon That part of the county which lies to the north of the southern boundary of the M4.
Cheshire That part of the county which lies to the west of the eastern boundary of the M6.
Clwyd Dyfed Gloucestershire } The whole county.
Greater Manchester That part of the county which comprises the district of Wigan.
Gwent Gwynedd Hereford and Worcester Lancashire Merseyside Mid Glamorgan } The whole county.
North Yorkshire That part of the county which comprises the district of Craven.
Powys Shropshire South Glamorgan } The whole county.
Staffordshire That part of the county which comprises the districts of Cannock Chase, Newcastle-under-Lyme, Stafford, Stoke-on-Trent and South Staffordshire.
West Glamorgan The whole county.
West Midlands That part of the county which comprises the districts of Birmingham, Dudley, Sandwell, Walsall and Wolverhampton.

Revocation

The Restriction on Movement of Spruce Wood (Amendment) Order 1986[^f00003] is hereby revoked.

Explanatory note

(This note is not part of the Order)

This Order further amends the Restriction on Movement of Spruce Wood Order 1982 by adding to the list of areas in respect of which the movement of spruce wood is restricted the remaining parts of the counties of Dyfed and Gwynedd not included in the previous Order and the county of West Glamorgan.

[^f00001]: 1967 c. 8; section 3(1) and (2) was amended by the European Communities Act 1972 (c. 68), section 4(1) and Schedule 4, paragraph 8(1) and (3); section 3(4) was substituted by the Criminal Justice Act 1982 (c. 48), section 42. The powers conferred by section 3 of the Plant Health Act 1967 are conferred on “a competent authority”, which expression is defined in section 1(2), as regards the protection of forest trees and timber from attack by pests, as the Forestry Commissioners.
