The Secretary of State, in exercise of the powers conferred on him by sections 21 and 273 of the Town and Country Planning (Scotland) Act 1972[^f00001]and of all other powers enabling him in that behalf, hereby makes the following Order:

The Town and Country Planning (General Development) (Scotland) Order 1981 is hereby amended as follows:—

“slurry” means animal faeces and urine (whether or not water has been added);

(c) any buildings exceeding 465 square metres in area for housing pigs, poultry, rabbits or animals bred for their skin or fur, and any associated structure or excavation for storing slurry or sewage sludge.

Explanatory note

(This note is not part of the Order)

This Order amends Class V (Agricultural buildings, works and uses) of Schedule 1 to the Town and Country Planning (General Development) (Scotland) Order 1981 to remove from permitted development (a) buildings of more than 465 square metres which are used to house pigs, poultry, rabbits or animals bred for their skin or fur, and (b) any structures associated with such buildings and used for storing slurry or sewage sludge. A definition of “slurry” is inserted into article 2 of the 1981 Order.
