The Pensions (Miscellaneous Offices) (Preservation of Benefits) (Amendment) Order 1989

Made: 15th June 1989

Coming into force: 6th July 1989

The Treasury, in exercise of powers conferred by sections 65 and 96 of the Social Security Act 1973[^f00001] and now vested in them[^f00002], hereby make the following Order:–

Citation and commencement

This Order may be cited as the Pensions (Miscellaneous Offices) (Preservation of Benefits) (Amendment) Order 1989 and shall come into force on 6th July 1989.

Interpretation

In this Order “the principal Order” means the Pensions (Miscellaneous Offices) (Preservation of Benefits) Order 1977[^f00003].

Office-holder’s pension: qualifying service

In article 5(1) of the principal Order there shall be substituted for the word “five” the word “two”.

This Order shall have effect from 6th April 1988.

Explanatory note

(This note is not part of the Order)

This Order amends the Pensions (Miscellaneous Offices) (Preservation of Benefits) Ortder 1977 by reducing from five to two, the number of years relevant service, which must be completed for benefits to be preserved, in order to comply with the amendment made by section 10 of the Social Security Act 1986 (c. 50) to Schedule 16 to the Social Security Act 1973. Under the power conferred by section 65 as read with sections 64(1)(b) and 64(10) of the Social Security Act 1973 this amendment has effect from 6th April 1988.
