The Road Traffic Act 1988 (Appointed Day for Section 15) (No. 2) Order 1989

Made: 14th July 1989

The Secretary of State for Transport, in exercise of the powers conferred by paragraph 1 of Schedule 5 to the Road Traffic (Consequential Provisions) Act 1988[^f00001] and of all other enabling powers, hereby makes the following Order:—

This Order may be cited as the Road Traffic Act 1988 (Appointed Day for Section 15) (No. 2) Order 1989.

The 1st September 1989 is the day appointed for the purposes of Schedule 5 to the Road Traffic (Consequential Provisions) Act 1988 in its application to the following provisions of section 15 of the Road Traffic Act 1988[^f00002], namely—

• (a) subsection (3) save in so far as 21st June 1989 was appointed by the Road Traffic Act 1988 (Appointed Day for Section 15) Order 1989[^f00003] for the purposes of that Schedule in its application to that subsection,

• (b) subsections (4), (7) and (8).

Explanatory note

(This note is not part of the Order)

Under Schedule 5 of the Road Traffic (Consequential Provisions) Act 1988, the Road Traffic Act 1988 has effect as if, until a date appointed by order, section 15(3) (wearing of seat belts by children in the rear of motor vehicles) were omitted and various consequential amendments were made. The Road Traffic Act 1988 (Appointed Day for Section 15) Order 1989 (S.I. 1989/1086) appointed 21st June 1989 as the appointed day under that Schedule for the purpose only of enabling regulations to be made in respect of section 15(3). This order appoints 1st September 1989 for the remaining purposes of Schedule 5. Accordingly, as from 1st September 1989, the Road Traffic Act 1988 will no longer be subject to the transitional provisions contained in that Schedule.
