The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[^f00001], and now vested in him[^f00002], and of all other enabling powers:

The lengths of the trunk road described in column 1 of the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road and shall be classified as principal road as from the date on which the Secretary of State for Transport gives notification that the new motorway between Umberslade and Warwick in the case of the lengths of the trunk road given the reference letters A and B in column 2 of that schedule, and between Warwick and Wendlebury in the case of the lengths of the trunk road given the reference letters C, D and E, is open for through traffic—

(a) in the case of the length given the reference letter A, to the Council of the Metropolitan Borough of Solihull;

(b) in the case of the lengths given the reference letters B and C, to the Warwickshire County Council;

In this Order—

(1) all measurements of distance are measured along the route of the relevant highways;

(i) “principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;

(ii) “the deposited plan” means the plan numbered HA10/2 WMRO (L) VIII marked “The A34 Winchester-Preston Trunk Road (North of Oxford to Monkspath) De-Trunking Order 1989”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(iii) “the trunk road” means the Winchester-Preston Trunk Road (A34);

(iv) “the new motorway” means the motorway to be provided by the Secretary of State in pursuance of the M40 London-Oxford-Birmingham Motorway (Umberslade to Warwick Section) and Connecting Roads Schemes 1976[^f00003], and the M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984[^f00004], (No. 2) Scheme 1985[^f00005] and (Supplementary) Scheme 1985[^f00006].

This Order shall come into force on 18th December 1989 and may be cited as the A34 Winchester-Preston Trunk Road (North of Oxford to Monkspath) De-Trunking Order 1989.

From the County Boundary at a point 150 metres south of its junction with the A4023 road to its junction with the A46 Stratford Northern Bypass, a distance of 16.7 km in the County of Warwickshire.	B
From its junction with the A46 Stratford Northern Bypass to its junction with the A439 in Stratford upon Avon, a distance of 2 km in the County of Warwickshire.	C
From its junction with the A429 north of Clopton Bridge in Stratford upon Avon to the County Boundary at its junction with the road from Little Compton to Great Rollright, a distance of 27.6 km in the County of Warwickshire.	D
From the County Boundary at its junction with the road from Little Compton to Great Rollright to its junction with the A43 at Peartree Hill Roundabout north of Oxford, a distance of 28.7 km in the County of Oxfordshire.	E
