The Local Government and Housing Act 1989 (Commencement No. 8 and Transitional Provisions) (Amendment) Order 1990

Made: 28th June 1990

The Secretary of State, in exercise of the powers conferred upon him by section 195(2) and (3) of the Local Government and Housing Act 1989[^f00001] and of all other powers enabling him in that behalf, hereby makes the following Order:

This Order may be cited as the Local Government and Housing Act 1989 (Commencement No. 8 and Transitional Provisions) (Amendment) Order 1990.

The Local Government and Housing Act 1989 (Commencement No. 8 and Transitional Provisions) Order 1990[^f00002] is hereby amended —

• (a) in article 3 by the omission of the words “sections 67 to 72 in so far as they are not alreadyin force” and “section 73”;

• (b) in article 3 by the substitution of the words “section 194(1) in so far as it relates to paragraphs 28(1) and (2) in so far as it confers a power to make regulations on the Secretary of State, 52, 63, 66 to 69, 90 and 91 of Schedule 11” for the words “section 194(1) in so far as it relates to paragraphs 3, 21, 28(1) and (2) in so far as it confers a power to make regulations onthe Secretary of State, 52, 63, 66 to 69, 90, 91 and 97 of Schedule 11”; and

• (c) in the Schedule by the omission of paragraph 1.

Explanatory note

(This note is not part of the Order)

This Order amends the Local Governmentand Housing Act 1989 (Commencement No. 8 and Transitional Provisions) Order 1990and provides that sections 67 to 73 of the Local Governmentand Housing Act 1989 (companies in which local authorities have interests), in so far as not already in force,and paragraphs 3, 21and 97 of Schedule 11 to the 1989 Act shall not come into force on1st July 1990 as specified in that Order.
