(This note is not part of the Order)

This Order is made under two provisions in section 22 of the Courts and Legal Services Act 1990 that relate to the Legal Services Ombudsman’s jurisdiction to investigate allegations about the manner in which a complaint made to a professional body has been dealt with by that body. Article 2 and Part I of the Schedule provide for the professional bodies over which the Ombudsman has jurisdiction. Article 3 and Part II of the Schedule secure that any issue which is being or has been determined by the Discipline and Appeals Committee of the Council for Licensed Conveyancers shall not be investigable by the Ombudsman. Section 22 of the 1990 Act (which establishes the Ombudsman) will come into force on 1st January 1991 as will section 21 (under which the Ombudsman is appointed) and related provisions.
