The Potassium Bromate (Prohibition as a Flour Improver) (Scotland) Regulations 1990

The Secretary of State, in exercise of the powers conferred on him by sections 4, 7 and 56 of the Food and Drugs (Scotland) Act 1956[^f00001] and of all other powers enabling him in that behalf, and after consultation in accordance with section 56(6) of the said Act with such organisations as appear to him to be representative of interests substantially affected by these Regulations, hereby makes the following Regulations:

Title and commencement

These Regulations may be cited as the Potassium Bromate (Prohibition as a Flour Improver) (Scotland) Regulations 1990 and shall come into force on 1st April 1990.

Amendment of the Miscellaneous Additives in Food (Scotland) Regulations 1980 and the Bread and Flour (Scotland) Regulations 1984

• (1) The Miscellaneous Additives in Food (Scotland) Regulations 1980[^f00002] shall be further amended by deleting–

• (a) from Parts I and II of Schedule 1 thereto the items relating to Potassium bromate; and

• (b) from Schedule 2 thereto, in respect of the items relating to “Bread” and “Flour”, the references in column 2 (Permitted Miscellaneous Additive) to Potassium bromate.

• (2) The Bread and Flour (Scotland) Regulations 1984[^f00003] shall be further amended by deleting–

• (a) from Schedule 3 thereto the item relating to 924 Potassium bromate; and

• (b) from paragraph 6 of Schedule 6 thereto–

• (i) in sub-paragraphs (2)(b) and (3)(b) the items relating to Potassium bromate; and

• (ii) in sub-paragraph (4)(a) and (b) the references in column (2) (Permitted Miscellaneous Additive) to Potassium bromate.

Explanatory note

(This note is not part of the Regulations)

These Regulations, which apply to Scotland only, come into force on 1st April 1990. The Regulations–

• (a) further amend the Miscellaneous Additives in Food (Scotland) Regulations 1980 by removing Potassium bromate both from the list of permitted miscellaneous additives under those Regulations and as a specified permitted miscellaneous additive (subject as prescribed in the Bread and Flour (Scotland) Regulations 1984) in relation to the specified foods of “Bread” and “Flour” respectively (regulation 2(1)), and

• (b) amend the Bread and Flour (Scotland) Regulations 1984 by removing Potassium bromate from amongst those additives specified as permitted in flour and bread (as more particularly described in the 1984 Regulations) as well as revoking those provisions by which, as an amendment, Potassium bromate was introduced in the 1980 Regulations as a specified permitted miscellaneous additive in “Bread” and “Flour” (regulation 2(2)).
