Act of Sederunt (Fees in the Scottish Record Office) 1990

Coming into force: 1st February 1990

The Lords of Council and Session, under and by virtue of the powers conferred on them by section 10 of the Public Records (Scotland) Act 1937[^f00001] and of all other powers enabling them in that behalf, and with the approval of the Treasury, do hereby enact and declare:

Citation and commencement

• (1) This Act of Sederunt may be cited as the Act of Sederunt (Fees in the Scottish Record Office) 1990 and shall come into force on 1st February 1990.

• (2) This Act of Sederunt shall be inserted in the Books of Sederunt.

Fees in the Scottish Record Office

The fees payable in the Scottish Record Office in respect of the matters specified in column 1 of the Table of Fees in the Schedule to this Act of Sederunt shall be the fees specified in relation to these matters in column 2 of that Table and are so payable from the date this Act of Sederunt comes into force.

Revocation

The Act of Sederunt (Amendment of Fees in the Scottish Record Office) 1980[^f00002] and the Act of Sederunt (Amendment of Fees in the Scottish Record Office) 1985[^f00003] are hereby revoked.

SCHEDULE — TABLE OF FEES

For the inspection of each volume, document or process

For the inspection of minute books and indices of the Register of Sasines, Registers of Inhibitions and Adjudications and other public records, affecting one property or one person for the following periods:–

Reprographic charges (to which are added, as appropriate, handling, authentication and posting and packing charges):–

• (1) Copies of an electrostatic process or similar method:

For the record retransmitted or transmitted to any court, or exhibited therein, at the instance of a party, in accordance with rules of court governing such transmissions or exhibitions

For attendance by an officer of the Scottish Record Office at any court to produce a record in evidence, for each day or part of a day, in addition to travelling expenses

For each Certificate issued under the Civil Jurisdiction and Judgments Act1982[^f00004]

For each Certificate of Custody that a deed is retained for permanent preservation

Explanatory note

(This note is not part of the Act of Sederunt)

This Act of Sederunt makes provision for an increase in most fees chargeable by the Scottish Record Office of 50 per cent. overall. The introduction of specification of size in electrostatic prints results in a reduction in one instance (see Schedule, Part III, item 1(2)(a)(i)). New fees are included for prints from microfiche and duplicate copies of existing microfiche.

The Act of Sederunt (Amendment of Fees in the Scottish Record Office) 1980 and the Act of Sederunt (Amendment of Fees in the Scottish Record Office) 1985 are revoked.
