Explanatory note

(This note does not form part of the Registrations)

1 These Regulations re-enact with modifications the provisions of the Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1989.

2 The Regulations prescribe the fees payable for the examination of vehicles and vehicle parts, the examination of complete vehicles and the issue of documents in connection with– 1 the type approval of vehicles and vehicle parts and the authorisation of the application of approval marks to vehicles and vehicle parts for the purposes of Community Instruments or ECE Regulations; and 2 the national scheme for the type approval of vehicles and vehicle parts established under sections 54 to 66 of the Road Traffic Act 1988, the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 (S.I. 1984/981) and the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 (S.I. 1982/1271).

3 In addition to minor and drafting changes, the Regulations make the following changes of substance.

4 The principal changes relate to the fee amounts. About 20% of the fees remain at their former levels, some are reduced, but most are increased.

5 A change is made in regulation 10 which is concerned with the fee payable where an examination of a vehicle involves persons, acting for or on behalf of the Secretary of State, visiting a place outside the United Kingdom. The previous Regulations provided that if the travelling and subsistence expenses or the time spent in travelling was less than expected there would be a refund of the balance of any payment made in respect of travelling and subsistence and the whole of any payment in respect of travelling time. This is replaced by a provision for the re-assessment of the fee where the actual expenses or time spent in travelling differs from the estimates, the difference being payable by or refundable to the applicant (as the case may be).

6 Regulation 12 requires cancellation fees to be paid where an application is cancelled. A provision is added to the effect that the only fee payable by an applicant on a cancellation is the cancellation fee and any fee payable under regulation 10.

7 The only other changes of substance are that, as a result of amending ECE Regulations, certain new fees relating to sealed-beam headlamps and halogen sealed-beam headlamps, have been added.
