Coming into force: 1st July 1991

The Treasury, in exercise of the powers conferred on them bysections 7(7) and 8(5) of the Criminal Justice (InternationalCo-operation) Act 1990[^f00001], hereby make the following Order:

This Order may be cited as the Criminal Justice (InternationalCo-operation) Act 1990 (Exercise of Powers) Order 1991 and shall comeinto operation on 1st July 1991.

In this Order—

In England and Wales and Northern Ireland, any powers exercisable bya constable under section 7 of the Act, shall also be exercisable by anofficer or by any person acting under the direction of an officer.

In Scotland, any powers to enter, search or seize granted undersection 8(1) of the Act shall also be exercisable by an officer or byany person acting under the direction of an officer.

Explanatory note

(This is not part of the Order)

Articles 3 and 4 of the Order apply to officers of Customs andExcise the provisions of sections 7 and 8 of the Criminal Justice(International Co-operation) Act 1990. Those provisions relate to powersof entry, search and seizure exercisable by the police for the purposeof obtaining evidence relevant to overseas investigations.
