The Secretary of State for Health, in exercise of powers conferred by sections 11 and 126(4) of the National Health Service Act 1977[^f00001] and of all other powers enabling him in that behalf, hereby makes the following Order:—

Enforceability of rights

Any right which was enforceable immediately before 1st April 1991 by or against the Authority shall be enforceable by or against the Secretary of State.

Investigation of complaints by Health Service Commissioner

Explanatory note

(This note is not part of the Order)

This Order makes provisions consequential on the termination of the Disablement Services Authority, a special health authority established under the National Health Service Act 1977. The Order transfers the Authority’s rights and liabilities to the Secretary of State. It also provides that the Health Service Commissioner may investigate complaints against the Authority as though such had been made in relation to the Secretary of State.
